Os MAUS TRATOS constituem uma das formas primitivas de expressão da
violência entre os seres humanos, recebendo ao longo do tempo, diversas
conceituações e denominações. No intuito de proteger a humanidade com relação
aos efeitos e consequências gerados pelos MAUS TRATOS, as sociedades têm
clamado por medidas preventivas e de proteção ao ser humano, que foram e vêm
sendo materializadas na forma de legislação, sendo que a cada novo diploma legal
editado, mais se particulariza, nomina e especifica quais as ações que
compreendem MAUS TRATOS. Concomitantemente, estudos estatísticos são feitos
no sentido de avaliar de que forma os MAUS TRATOS se expressam, para que
medidas profiláticas e de prevenção aos seus agravos sejam tomadas. Não se pode
omitir o importante papel da Perícia como partícipe no diagnóstico preciso de tais
eventos, porém, nem sempre são os exames periciais requisitados de forma a
satisfazer aos múltiplos conceitos postos pela legislação, sua aplicação, bem como
dos procedimentos preconizados.
Estes foram os motivos que levaram ao estudo dos MAUS TRATOS, neste
trabalho abordados.
Analisou – se de forma capitular: os múltiplos conceitos e definições de MAUS
TRATOS bem como a Legislação que serve de suporte em seu combate e
prevenção; o histórico da forma como os MAUS TRATOS são considerados e
tratados nos diversos continentes e no Brasil; as medidas estatísticas de suas
incidências, através dos métodos estatísticos existentes e disponíveis, e, as perícias
feitas tanto nos locais em que eles ocorrem, bem como nos vestígios por eles
deixados, e, principalmente com relação aos exames feitos nas pessoas agentes de
MAUS TRATOS, dando-se ênfase às formas pelas quais os exames periciais são
requisitados e realizados.
Diante do encontrado, fez-se breve discussão sobre tópicos considerados
como passíveis de revisão e sugestões para u’a melhor utilização dos meios de
entendimento, diagnóstico e enfrentamento desse tipo de violência. Deu-se especial
atenção à: conceituação de MAUS TRATOS; adequação da legislação a eles
destinada; metodologia estatística de sua análise; formas de solicitação das perícias

e dos exames periciais; registros das informações obtidas e perguntas ou quesitos a
serem formulados e respondidos às autoridades envolvidas nos procedimentos
investigativos e naqueles demais voltados à esfera jurídica.
Por fim, foram tecidas considerações sobre os MAUS TRATOS em si, suas
formas de expressão e tratamento preventivo-profilático.

ABSTRACT
The MALTREATMENT constitutes an expression of primitive forms of violence
between humans, receiving over time, several concepts and names. In order to
protect humanity with regard to the effects and consequences generated by
MALTREATMENT, companies have been calling for preventive measures and
protection of the human being, which have been and are being materialized in the
form of legislation, with each new statute published; the more particularized,
nominate and specifies what actions comprise MALTREATMENT. Concurrently,
statistical studies are made to assess how the MALTREATMENT express
themselves, so that preventive measures and to prevent their injuries are taken. One
can not omit the important role of Expertise as a participant in the precise diagnosis
of such events, however, are not always the forensic exams required to meet the
multiple concepts posed by the legislation, its implementation, as well as the
procedures advocated. advocated.
These were the reasons that led to the study of maltreatment, this study
addressed.
Was examined in capitulary form: the multiple concepts and definitions of
maltreatment and the law which carries in its fight against and prevention; the history
of how MALTREATMENT are considered and treated in different continents and in
Brazil; measures statistics of its implications through the existing and available
statistical methods, and their expertise made in both places where they occur, and
the traces left by them, and especially those related to tests on the people
MALTREATMENT agents, giving emphasis is on ways in which forensic exams are
required and performed.

Given the Met, it was brief discussion on topics considered as candidates for

review and suggestions for a better use of resources for understanding, diagnosing
and managing this type of violence. It was gave special attention to: the
conceptualization of MALTREATMENT; adequacy of legislation aimed at them;
statistical methodology of analysis, forms of application of skills technical expertise;
records of information obtained or questions and how the questions information have
to bee formatted and answered to the authorities involved in investigative
procedures.
Finally, considerations were made on the mistreatment itself, its forms of
expression and preventive and prophylactic treatment.
